By accessing and using Declair, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

2. Description of Service

Declair is a polling platform that uses pairwise comparison to help groups make clear, confident choices. The service is currently in public beta.

3. User Accounts

To create polls, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Content

You retain ownership of the polls, options, descriptions, and images you create or upload. By using the platform, you grant Declair a non-exclusive, worldwide license to store, process, and display this content as necessary to provide the service.

You are solely responsible for all content you submit, including uploaded images. You represent and warrant that:

• You own or have the necessary rights and permissions to upload and use the content
• Your content does not infringe on any third party's intellectual property, privacy, or other rights
• Your content does not contain illegal, harmful, or objectionable material

Declair does not claim ownership of user-uploaded content and assumes no liability for the content users upload. We reserve the right to remove any content that violates these terms. You agree to indemnify Declair against any claims arising from content you upload or share through the platform.

5. Acceptable Use

You agree not to:

• Use the platform for any illegal purpose
• Attempt to gain unauthorized access to the service
• Interfere with the proper functioning of the platform
• Create misleading or deceptive polls
• Upload images you do not have the rights to use, or that infringe on others' intellectual property
• Upload content that is illegal, obscene, defamatory, or otherwise objectionable
• Use automated tools to abuse the service

6. Service Availability

Declair is provided on an "as is" basis. We make reasonable efforts to maintain service availability but do not guarantee uninterrupted access. As a beta service, features and availability may change.

7. Limitation of Liability

Declair is a poll and decision-support tool. We are not liable for any choices made based on results from the platform. Users should exercise their own judgment when using poll outcomes.

8. Changes to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
